By using https://thaitouch.co.nz you are agreeing to the terms and conditions laid out below.

Privacy

Your privacy and that of other users of the site is important to us. https://thaitouch.co.nz is allowed to collect and store data and information for the purpose of exclusion and many other purposes. We use information that you provide to us (either directly or via first/third party cookies) to fulfill your orders, to make service offerings, and to customize the site to meet your needs. Google and other third party vendors may serve ads based on your visit to our website. If you would like to opt-out of Google’s use of cookies you can do it here by visiting Google’s ad settings. We may email you or contact you in other ways to achieve these same goals.  Our banks and other third party service vendors may have access to subsets of information you provide to us. We do not control how these third parties use such information, but we do ask them to disclose how they use personal information provided to them by users of the site. You may “opt out” of receiving emails from us or any other party outlined above by clicking “unsubscribe” in their email messages.

Your orders

All transactions are made in New Zealand dollars. All booked massage sessions are delivered at our Tauranga-based studios:

• Bethlehem Studio – R222 State Highway 2, Bethlehem, Tauranga

• Mount Studio – 12A Prince Avenue, Mount Maunganui

• Tauranga Studio - 64A Elizabeth Street, Tauranga.

Orders are despatched when they have been paid for. If you do not receive a confirmation email within 10 minutes, first check your spam folder and if you find no message from Thai Touch then please drop us an email to team@thaitouch.co.nz.

We may accept or refuse orders for any reason. When factors beyond our control prevent us providing us an offer that you have ordered, we will seek to substitute the order product with an equivalent or superior product.

Standard (non-discounted price) Thai Touch massage vouchers are valid for the purchased massage(s) until 12 months from the date of purchase.

Promotional (discounted price) Thai Touch massage vouchers are valid for:

• The purchased massage(s) until three months from the date of purchase or

• The purchase price of the voucher can be used as part payment towards any other full-priced massage at Thai Touch until 12 months from the date of purchase.

All Thai Touch massage vouchers are:

• Transferable to a friend or family member provided that the original voucher is presented

• Non-refundable unless required by law

• Not eligible for cash-back

• Not for use with any other offers.

Thai Touch bookings policy is that you must provide your voucher number when making a booking for a session that you wish to pay for by voucher.

Payments

All prices are in New Zealand dollars and include GST.

Stripe and KiwiBank deliver our secure payments system. No credit card details are stored by the Site.

Cancellation and refunds

If you are a purchaser, you may obtain a refund to your card provided you message us within 24 hours of the purchase – just message team@thaitouch.co.nz.

Vouchers are rendered void if you fail to provide at least 24 hours notification of cancellation of a booking.

For all bookings, please bear in mind that we are unlikely to be able to fill slots at short notice and that our costs remain the same if you do not come – we greatly appreciate you letting us know :

• As soon as you know that you are unable to make a booked slot

• Preferably at least by the previous evening if you are able.

Failure to give timely notice will incur a late cancellation fee:

• 50% of session cost for:

  • Less than four business hours notice of cancellation for bookings for 1 or 2 people

  • Less than 12 business hours notice of cancellation for bookings for 3 to 6 people

  • Less than 24 business hours notice of cancellation for bookings for more than 6 people

• 100% of session cost for cancelling any session with less than two business hours notice, including not showing for appointment.

In this context, a business hour is an hour for which Thai Touch is open – typically 9 am through 9 pm each day. For example, to give four business hours notice of a 10 am appointment, you would need to cancel by 6 pm on the previous evening.

If your experience with any of our massages is unsatisfactory to you, please let us know immediately and we will find a solution for you.

Disclaimer

Except for Couples vouchers, each voucher is to be used by a single person in a single visit. A couples voucher is for use by a couple sharing one massage room in a single visit.

We assume no responsibility for damage caused by corrupting code or data (including but not limited to viruses or worms) that may be inadvertently passed to the device you use to access the Site or that of any other device or person with which you may subsequently communicate . You interact with the Site, or banners or pop-ups or advertising displayed thereon, at your own risk.

We make no warranty that the Site will operate without error or loss of information. Any or all information on the Site can be changed at any time without notification.

The Site disclaims any and all responsibility for the accuracy of the content appearing at, linked to on, or mentioned on https://thaitouch.co.nz. You assume all risk relating to viewing, reading, using, or relying upon this information. Unless you have otherwise formed an express contract to the contrary with us, you have no right to rely on any information contained herein as accurate. We make no such warranty.

Liability

Except where prohibited by law the Site will not be liable for any indirect, consequential, exemplary, incidental or punitive damages. For any jurisdictions that may now allow for these exclusions our maximum liability will not exceed the amount paid by you, if any, for using our website or service.

Notice

You expressly warrant an understanding that the right to notice is waived as a condition for permission to view or interact with the website.

Disputes

In the event of a dispute arising between you and us, the parties shall make all efforts to resolve the dispute; otherwise a mediator shall be appointed by agreement between the parties to resolve the dispute and failing agreement as to the appointment of the mediator the dispute shall be dealt with in accordance with the provisions of the Arbitration Act 1996 and its amendments.

Applicable law

This agreement will be subject to New Zealand law. The New Zealand courts will have exclusive jurisdiction in respect of this agreesment and the parties hereby submit to that jurisdiction.
